I. Application of the Terms of Use
These Terms of Use (hereinafter: ToU) shall apply to any and all natural, legal and other persons or associations (hereinafter: User(s)) who access and use the Cherrybox24 website at http://www.cherrybox24.com (hereinafter: Website), which is owned and managed by GS NEONBIT Ltd., Tower Bridge Business Complex, B402, 100 Clements road, London, United Kingdom, SE16 4DG, Company No. 09657165 (hereinafter: Provider).
In addition to the ToU, the relationship between User and Provider may also be subject to a separate contract. Entering into a separate contract is an option and not and obligation of the User. In the case of discrepancies between the provisions of the contract and those of the ToU, the provisions of the contract shall take precedence.
Nothing in the ToU shall constitute a partnership or joint venture or agency relationship between the User and the Provider.
Certain parts (subpages) of the Website or certain functionalities thereof may be subject to special terms and conditions. If the infringement recurs, the Provider may, at its sole discretion, permanently prevent the User from accessing and using the Website. In such case, any and all rights of the User, including, but not limited to, rights granted under a separate contract between the User and the Provider, shall be terminated and the User shall not be entitled to any reimbursements of the paid fees or expenses.
III. Intellectual Property Rights
The contents of the Website, regardless of the format (text, images, films, sounds, etc.) is the sole property of the Provider (or other designated owners) and protected by copyright laws and other intellectual property rights laws.

Cherrybox24 and other trademarks are registered trademarks of the Provider and are protected under the national and international legislation.
IV. Exclusion of Liability
The User acknowledges that certain content on the Website has been provided by third parties (not affiliated with Provider) and has therefore not been validated or verified by Provider. Provider assumes no liability for any damage suffered by the User due to the use of such third party content.
Provider does not warrant the accuracy, completeness and correctness of the information published on the Website, nor does it assume liability for any damage suffered by the User due to relying on the published information.
Provider does not warrant the functioning or accessibility of the Website and assumes no liability for any damage suffered by the User due to the inaccessibility, non-functioning or malfunctioning of the Website.
Provider assumes no liability for any damage that may be caused to the User's hardware, software or other equipment due to use of the Website.
If for any reason the exclusion of liability is void or unenforceable, Provider’s liability shall be limited to the maximum extent permitted by law.
V. Final Provisions
If any provision of ToU is invalid for any reason, this invalidity shall not affect the rest of the ToU. In such case, the invalid provision shall be deemed non-existent and the ToU shall apply without such provision.
Any legal relationship between the User and the Provider based on User’s use of Website shall be governed by and construed in accordance with the law of England and English courts shall have jurisdiction to hear any disputes or disagreements arising from or related to these ToU or the User’s use of the Website.
These ToU enter into force on July 10, 2015.
